Our partner clinics in Turkey act as independent data controllers. Therefore, data processing by our partner clinics is subject to applicable data protection regulations in their jurisdiction. Swiss Aesthetic Vision is not liable for data processing by third parties. -
Data Transfer to Third Countries
To fulfill our mediation services, we transfer personal data to our partner clinics in Turkey. Under European law, Turkey is not recognized as a country with an adequate level of data protection. To ensure the protection of your data, we enter into contracts with our partners based on the EU Commission’s standard contractual clauses to ensure the protection of your personal data even in third countries. -
Data Retention Period
We store your personal data only as long as it is necessary to fulfill the purposes mentioned above or as required by law. Once the purpose of processing ceases or the legal retention period expires, your data will be deleted or anonymized. -

General Terms and Conditions (AGB) of Swiss Aesthetic Vision

General Provisions
These General Terms and Conditions (AGB) apply to all contracts between Swiss Aesthetic Vision (hereinafter referred to as the "Mediator") and users of our services (hereinafter referred to as "Clients"). By using our services, the Client agrees to these AGB. -
Services of Swiss Aesthetic Vision
Swiss Aesthetic Vision offers services for the arrangement of aesthetic-medical treatments with partner clinics. Our activity is limited exclusively to mediating treatments in partner clinics in Turkey. We do not perform any medical treatments ourselves and do not provide medical advice. -
Mediation Contract and Treatment Contract
By using our services, only a mediation contract between the Client and Swiss Aesthetic Vision is concluded. This contract includes the organization and arrangement of an aesthetic-medical procedure in a partner clinic in Turkey.
The treatment contract regarding the actual provision of medical services is concluded directly between the Client and the respective partner clinic. Swiss Aesthetic Vision is not a contracting party to the treatment contract and assumes no liability for the provision of medical services.

Disclaimer
Swiss Aesthetic Vision is not liable for damages arising from medical treatment in partner clinics. Any claims relating to the performance of the treatment, including claims for damages, must be made directly against the partner clinic.
Our liability is limited to the proper fulfillment of mediation services. We are liable only for intentional acts and gross negligence.

Warranty and Guarantee
The partner clinics are obligated to perform the medical procedure according to the agreements made between the Client and the clinic and the AGB of the clinic in effect at the time of treatment. These agreements and AGB are concluded in writing on-site by the Client and the partner clinic. Swiss Aesthetic Vision acts solely as a mediator in this context and ensures that the Client has all necessary information to conclude the agreement correctly.
The partner clinics provide a 5-year guarantee for the aesthetic-medical procedure agreed upon. This guarantee covers only the procedure specified in the written agreement between the Client and the clinic.
Corrections: In the event of a necessary correction, this guarantee is limited to errors or defects directly related to the original procedure as agreed in writing. Corrections based on other or Client-requested changes outside the originally agreed scope of service are excluded from the guarantee.
The clinic undertakes to carry out all corrections that fall within the scope of the guarantee in a professional manner and in accordance with medical standards. Should the Client experience complications or dissatisfaction regarding the agreed procedure after the treatment, the partner clinic is obligated to examine the matter promptly and, if necessary, act within the framework of the guarantee.
Swiss Aesthetic Vision is not liable for the performance or compliance with the guarantee terms by the partner clinic. All claims regarding the warranty and the execution of corrections are to be directed to the partner clinic.

Prices and Payment Terms
The prices for aesthetic-medical procedures are determined by the partner clinics. Swiss Aesthetic Vision does not charge additional fees for mediation services. Payments are made directly to the partner clinic with which the Client concludes the treatment contract. -
Cancellation and Withdrawal
The cancellation terms are determined by the individual terms of the respective partner clinic with which the Client concludes the treatment contract. Swiss Aesthetic Vision is not responsible for any cancellation fees charged by the partner clinics.
In the event of a cancellation by the Client, the following rules apply:
The Client has no right to a refund of mediation fees, as Swiss Aesthetic Vision does not charge separate mediation fees.
Cancellations or changes to the treatment date must be coordinated directly with the partner clinic. The deadlines and terms set there apply.
If the clinic needs to reschedule or cancel an appointment, it will inform the Client promptly. Swiss Aesthetic Vision is not liable for any resulting inconvenience, costs, or losses.

Client Obligations
The Client is required to provide all necessary information accurately and truthfully for the mediation and implementation of the desired medical treatment. This includes medical history, relevant pre-existing conditions, and personal data required for treatment planning.
The Client is also responsible for preparing for the procedure in a timely manner, following all medical instructions, and informing the clinic of any changes in health status.
Swiss Aesthetic Vision is not responsible for any complications that may arise from incomplete or incorrect information provided by the Client.

Obligations of Swiss Aesthetic Vision
Swiss Aesthetic Vision undertakes to refer Clients to qualified and reliable partner clinics to the best of its knowledge and belief. We carefully review the qualifications and experience of the clinics and doctors, but cannot guarantee the success of the treatment or the medical quality of the service.
We strive to respond to all Client questions and inquiries promptly and comprehensively and provide support throughout the mediation process. Our liability is limited to the proper fulfillment of mediation services.

Insurance Coverage
Swiss Aesthetic Vision strongly recommends that all Clients take out travel and health insurance to cover potential medical complications abroad as well as possible repatriation. These insurances are not part of the services offered by Swiss Aesthetic Vision and must be arranged by the Client.
The Client is also responsible for ensuring that they are in good health and medically fit for the planned procedure.

Data Protection
The protection of your personal data is important to us. The processing of personal data is carried out in accordance with our privacy policy and applicable data protection regulations, particularly the GDPR.
All personal data we collect is used exclusively for the purpose of mediation with partner clinics. Data is only shared with third parties when necessary to fulfill the contract or with your explicit consent.

Dispute Resolution and Jurisdiction
All disputes arising from the mediation contract between Swiss Aesthetic Vision and the Client are subject exclusively to Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods.
The exclusive place of jurisdiction for all disputes is the registered office of Swiss Aesthetic Vision, unless mandatory legal provisions specify otherwise.

Severability Clause
If any individual provisions of these AGB are invalid or become so, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision. -
Changes to the AGB
Swiss Aesthetic Vision reserves the right to amend these AGB at any time if necessary to meet legal requirements or adapt the services offered. Clients will be informed of the amended AGB in a timely manner. Continuing to use our services after the announcement of changes constitutes acceptance of the amended conditions. -
Final Provisions
These AGB come into effect upon publication and apply to all contracts concluded after this date.
